Can I Keep My House If I Owe Federal Restitution Before Prison?

Quick Answer

A person who owes federal restitution may be able to keep a home in some situations, but no one should guess. The answer depends on the judgment, restitution order, forfeiture order, DOJ lien, mortgage documents, ownership, equity, payment schedule, and collection action.

Before using retirement funds, transferring money, selling property, or vacating a home before surrender, the documents should be reviewed. A wrong move can create tax, forfeiture, restitution, or contempt problems.

Why This Comes Up Before Surrender

Federal fraud defendants often focus on sentencing and then realize the family still has a mortgage, accounts, taxes, insurance, property, and restitution obligations to manage while the defendant is in custody. Once the person reports to the BOP, signing papers and authorizing payments becomes much harder.

Release planning now is also important because time in custody can be minimized only if the person protects Good Conduct Time, FSA eligibility, RDAP documentation, sentence computation, and home confinement planning.

Answer

Do not decide whether to keep or vacate a house based on fear alone. Review the lien, judgment, restitution order, forfeiture documents, mortgage records, and BOP release plan before moving money or leaving the home.
